Terms of Service

1. Acceptance of Terms

By accessing or using the Circle Payment platform and services, you agree to be bound by these Terms of Service. If you are entering into these terms on behalf of a business, you represent that you have the authority to bind that entity.

2. Description of Service

CIRCLE provides payment processing infrastructure, hardware, and software solutions for merchants. We act as a gateway and service provider between your business and various financial networks.

3. Merchant Obligations

As a merchant using CIRCLE, you agree to:

• Comply with all applicable Card Network rules (Visa, Mastercard, etc.).
• Maintain PCI-DSS compliance if handling sensitive cardholder data.
• Provide accurate and complete information during the onboarding process.
• Not use the services for any prohibited or illegal business activities.

4. Fees and Settlement

Fees for our services are set forth in your specific Merchant Agreement. Settlements are processed according to the funding schedule selected (e.g., Same-Day or Next-Day funding). We reserve the right to hold reserves or delay funding if suspicious activity is detected.

5. Limitation of Liability

CIRCLE shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use our services, including but not limited to lost profits or data.

6. SMS/Mobile Messaging Terms

By providing your phone number to Circle Payment, you agree to receive recurring automated informational text (e.g., SMS and MMS) messages from us, including messages regarding support, customer care, and notifications about using our restaurants POS software, to the mobile telephone number you provided.

• Consent: Consent to receive automated text messages is not a condition of any purchase.
• Rates: Message and data rates may apply.
• Frequency: Message frequency will vary.
• Carriers: Carriers are not liable for delayed or undelivered messages.
• Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.
• Support: If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at office@circleisv.com.

7. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
